**1. Scope **
These General Terms and Conditions apply to all bookings and passenger transport services concluded via this booking website. Mandatory statutory provisions remain unaffected.
2. Contracting Party & Contact
FAMILY OF POWER SCE, Hauptstraße 65, A-9545 Radenthein Please visit https://www.familyofpower.com/impressum
3. Description of Services & Conclusion of Contract
The services displayed on the website (trips, options, prices) are non-binding. A contract is only concluded upon our electronic booking confirmation. Users are responsible for the accuracy of their information (pickup location, destination, time, number of passengers, special requirements).
4. Prices & Payment
Unless otherwise indicated, prices include all taxes and duties. Accepted payment methods are displayed during checkout. Any fees (e.g. for short-term changes) will be shown before confirmation.
5. Cancellation, Rebooking & No-Show
Cancellations/rebookings are possible within the deadlines specified during the booking process; thereafter, cancellation fees may apply. In the case of a no-show (failure to appear at the agreed time/place), the full fare may be charged unless a statutory right of withdrawal applies.
No right of withdrawal:
For passenger transport services provided at a specific date or within a specific period, there is no 14-day right of withdrawal pursuant to § 18 (1) lit. b Austrian Distance Selling Act (FAGG). This notice is given expressly prior to the conclusion of the contract.
6. Conditions of Carriage (Excerpt)
The relevant provisions of the BO 1994 apply (e.g. vehicle requirements, operating and carriage conditions, staff qualifications). Carriage may be refused if there are justified reasons (safety risks, prohibited luggage). Hand luggage is permitted within safety limits. Animals may only be transported by prior arrangement; assistance dogs are exempt.
Accessibility: Barrier-free transport is provided in accordance with legal requirements; available capacities must be agreed in advance.
7. Obligations of Passengers
Passengers must arrive punctually at the pickup point; any delays must be reported immediately. Passengers must follow the instructions of the driving staff and comply with legal safety rules (e.g. seatbelt obligation). Passengers are required to treat the vehicle and equipment with care; they may be held liable for any damage caused by negligence.
8. Availability & Force Majeure
We make every effort to keep the website available without interruption and to carry out journeys as scheduled. However, delays or cancellations due to force majeure (e.g. severe weather, traffic, regulatory requirements) do not give rise to claims for damages. We reserve the right to adjust services where objectively justified and reasonable.
9. Liability
We are fully liable for intent, gross negligence, and for personal injury. In the case of slight negligence, we are liable – to the extent legally permissible – only for the breach of essential contractual obligations (cardinal duties) and limited to the foreseeable, typical damage. Statutory warranty rights remain unaffected.
10. Data Protection & Cookies
The processing of personal data is carried out in accordance with our Privacy Policy. We use technically necessary cookies for user accounts, bookings, and security. Optional functions (e.g. GPS-based location search if activated in the browser) are only used with consent.
11. Online Dispute Resolution
The European Commission provides a platform for Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr
We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
12. Applicable Law & Jurisdiction
Austrian law shall apply, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). For actions against consumers, the statutory places of jurisdiction apply; in business transactions with entrepreneurs, the place of jurisdiction is Klagenfurt.
13. Final Provisions
Should any individual provisions be invalid, the validity of the remaining provisions shall remain unaffected. Amendments to these General Terms and Conditions must be made in text form.
